孟晚舟律师就起诉加拿大政府发声明:拘留、搜查、审讯时加官员多次违法渎职

诉讼书称,孟女士宪法权利遭到严重侵害,2018年12月1日孟女士在温哥华国际机场被拘留、搜查、审讯时,加拿大政府官员多次违反法治,就公职人员渎职和非法监禁寻求损害赔偿。

央视新闻报道称,北京时间今日早间,据当地媒体报道,华为公司首席财务官孟晚舟女士的律师团已经对加拿大政府、加拿大边境服务局和皇家骑警(即联邦警察)提起诉讼,指控他们在未告知她的情况下,就对她进行逮捕、搜查和审讯,这些做法都侵犯了她的宪法权利。

孟晚舟是2018年12月1日在乘飞机过境温哥华的时候被加拿大警方逮捕的,加方是按照美国的要求和加美引渡协议实施逮捕的,她目前已经获得保释。

3月2日,加拿大签发授权推进令、启动引渡程序,这意味着在当地时间3月6日,加方法庭将对是否允许美国引渡她进行听证和裁决。随后孟晚舟律师发表声明,再次明确美国的指控是出于政治动机,其指控的行为在加拿大根本不构成犯罪,孟女士没有任何不当行为,希望孟女士的合法权利在引渡过程中的司法阶段能得到保护。

加拿大时间2019年3月1日,律师代表孟晚舟女士向加拿大不列颠哥伦比亚省最高法院提交了一份针对加拿大边境服务局、加拿大皇家骑警和加拿大政府的民事诉讼通知书。诉讼书称,孟女士宪法权利遭到严重侵害,2018年12月1日孟女士在温哥华国际机场被拘留、搜查、审讯时,加拿大政府官员多次违反法治,就公职人员渎职和非法监禁寻求损害赔偿。起诉书中已说明了相关情况,案件正在法院审理中,目前没有进一步评论。

On March 1, 2019, a Notice of Civil Claim was filed in the British Columbia Supreme Court on behalf of Wanzhou Meng against members of the Canada Border Services Agency, the Royal Canadian Mounted Police and the Government of Canada alleging serious breaches of her constitutional rights and seeking damages for misfeasance in public office and false imprisonment based on alleged multiple failures of those Canadian government officials to comply with the rule of law upon her detention, search, and interrogation at Vancouver International Airport on December 1, 2018.

As the claim speaks for itself and the matter is now before the Courts, no further comments are necessary or appropriate at this time.

1.We aredisappointed that the Minister of Justice has decided to issue an Authority toProceed in the face of the political nature of the U.S, charges and where thePresident of the United States has repeatedly stated that he would interfere inMs. Meng’s case if he thought it would assist the U.S negotiations with Chinaover a trade deal.

2.We are alsoconcerned that the Minister has approved an ATP in circumstances where theconduct alleged to be an offence in the U.S. would not be an offence inCanada.  This is an affront to the foundational extradition principle ofdouble criminality.

3.Our clientmaintains that she is innocent of any wrongdoing and that the U.S. prosecutionand extradition constitutes an abuse of the processes of law.

4.Our client looksforward to having her rights vindicated in the judicial phase of theextradition process.
